The Court Clerk is responsible for receiving all citations issued aboard CBC Gulfport, processing citations, and managing the installation's Lost and Found program.
Citations
The CBC Security Department aggressively enforces all traffic regulations on Federal property Citations issued aboard CBC Gulfport are the DD Form 1408, Armed Forces Traffic Citation and DD Form 1805, United States District Court Violation Notice.
1. The DD Form 1408 is a citation issued primarily to military members for minor infractions on CBC Gulfport. The DD Form 1408 applies to on-base offenses and affects only on-base driving privileges. On-base driving privileges are managed using a point system. Offenses carry a corresponding point value, depending on the severity of the offense. Driving privileges may be suspended for persons accruing 12 or more points within a year and/or 18 or more points within 2 years. Offenses are divided into two categories, optional and mandatory court appearances.
a. Optional Court Appearance . A person issued a DD Form 1408 for infractions not requiring a mandatory court appearance has the option to plead "no contest" at the time that the citation is issued. Another option is to contact the Traffic Court Clerk at least 10 work days prior to scheduled court date. Failure to plead the infraction prior to the court date results in a mandatory court appearance.
b. Mandatory Court Appearance. A person issued a DD Form 1408 for infractions requiring a mandatory court appearance must appear in Traffic Court on the date annotated in the margin of the citation. Failure to appear for a mandatory appearance violation will result in a minimum 6-month suspension of base driving privileges.
c. Suspension of Driving Privileges as a result of a DD Form 1408 infraction affects only driving privileges on military installations. (Local military installations share suspended driver information) Persons found operating a vehicle on an installation while their base privileges are suspended will receive an additional two year suspension. Suspension of driving privileges may be appealed. For assistance with the appeal process, contact the Traffic Court Clerk.
d. Traffic Court is scheduled twice each month and is held in the Courtroom in Building 30, the Fleet and Family Support Center. Traffic Court is an official appointment and wear of the uniform by military personnel is required. Those scheduled for Traffic Court must bring their military identification (or base access credentials) and driver's license.
2. The DD Form 1805 is a pleading that initiates a criminal case in the United States District Court which includes the Magistrate's Court where citations are adjudicated. Federal citations are issued for offenses occurring in areas where the federal government has jurisdiction over the person of the offense committed. NCBC Gulfport is a concurrent jurisdiction installation in which federal and state laws apply to all military and civilians present onboard the base. Accordingly, federal citations may be issued anywhere onboard the installation. The DD Form 1805 is primarily issued to civilian members for minor infractions of base or local civil laws. The Command may direct issuance of the DD Form to military members for command-interest infractions.
a. There are optional and mandatory court appearance offenses. However, with the DD Form 1805 a fine is levied for offenses not requiring a mandatory court appearance. Fines range between $25.00 and $250 per infraction, plus court fees. Those wishing to contest the citation are required to attend Magistrate Court. Those persons cited for infractions resulting in a mandatory court appearance will be notified by mail of their court date. Failure to appear for Magistrate Court may result in suspension/revocation of State Driver's License and a bench warrant issued for arrest of the cited person.

3. Lost and Found. The Traffic Court Clerk's office is the base repository for lost and found items. Persons wishing to turn in found items or claim lost items should contact the Traffic Court Clerk's office during normal office hours.
